1. About These Terms

These Terms and Conditions govern the relationship between Bunga Damai (referred to throughout as "the firm", "we", or "us") and any person who visits this website or engages the firm's services (referred to as "the client" or "you"). By using this website or instructing the firm, you confirm that you have read and accepted these terms.

These terms do not replace or supersede the formal letter of engagement issued at the start of a legal matter. Where any conflict arises between these terms and the letter of engagement, the letter of engagement will take precedence.

2. Our Services

Bunga Damai provides family law services to individuals in Malaysia, including but not limited to: plain-language family letter drafting, family mediation coordination, and comprehensive family affairs reviews. A full description of each service is available on the Solutions page of this website.

The firm operates as a legal services provider and all advice given is subject to the professional rules of the Malaysian Bar. Nothing on this website constitutes formal legal advice. Formal advice is provided only through a confirmed letter of engagement.

3. Engagement and Fees

Services are provided only following a confirmed letter of engagement, which sets out the scope of work, fees, and any specific arrangements agreed with the client. Fees published on this website are indicative and reflect standard engagements. The actual fee for any matter will be confirmed in writing before work commences.

Unless otherwise stated in the letter of engagement, fees are payable in full or in agreed instalments as set out in that document. The firm reserves the right to pause work on a matter where fees remain outstanding for more than fourteen days beyond a due date, having given written notice of the intention to do so.

All fees are quoted and payable in Malaysian Ringgit (RM). The firm does not charge or accept payment in foreign currencies without prior written agreement.

4. Scope Limitations

The firm undertakes to perform the services described in each letter of engagement with reasonable care and skill. The firm does not warrant any particular outcome from its services, and family law matters often depend on circumstances beyond the firm's knowledge or control.

The firm's responsibilities are limited to the scope set out in the letter of engagement. Work falling outside that scope — including advice sought informally by telephone or email beyond what the engagement covers — is not included and may require a separate arrangement.

5. Client Responsibilities

Clients are asked to provide complete and accurate information relevant to their matter. The firm's ability to act effectively depends on the accuracy of the information provided. If material information changes during an engagement, the client should inform the firm without undue delay.

Clients are also responsible for making decisions about their own legal matters. The firm provides information, advice, and documentation to support those decisions; it does not make decisions on the client's behalf.

6. Confidentiality

All information provided to the firm in the course of an engagement is held in strict confidence. We do not disclose client information to any third party except where required by law, where necessary for the conduct of the matter with the client's knowledge, or where the client has given explicit written consent.

This confidentiality obligation survives the conclusion of any engagement and applies to former clients as well as current ones.

7. Website Use

This website is provided for general information about the firm and its services. Content on this website is prepared with care but may not reflect the most recent changes in law. Nothing on this website should be treated as specific legal advice applicable to your personal circumstances.

You may not use this website to collect information for commercial purposes, to reproduce content without permission, or to make any use that would bring the firm into disrepute or that is otherwise unlawful. The firm reserves the right to restrict access to the website without notice.

8. Intellectual Property

All text, design, and content on this website is the property of Bunga Damai unless otherwise attributed. You may print or download content for your own private, non-commercial use. Any reproduction, redistribution, or commercial use of website content requires prior written consent from the firm.

Legal documents prepared for a client during an engagement become the property of that client upon full settlement of fees. Draft documents and working notes remain the firm's property.

9. Limitation of Liability

The firm's liability to any client in connection with any engagement is limited to the fees paid for that specific engagement. The firm is not liable for indirect, consequential, or incidental loss arising from any matter, including loss of income, emotional distress, or the outcome of any legal proceeding.

This limitation does not apply to liability arising from the firm's gross negligence or wilful misconduct, and is subject to the professional indemnity obligations required by the Malaysian Bar.

10. Termination of Engagement

Either party may bring an engagement to a close by giving reasonable written notice. The firm may cease to act for a client where, in its professional judgment, continuing to act would create a conflict of interest, where the client's instructions would require the firm to act improperly, or where the relationship of trust has broken down. In such circumstances, the firm will give the client adequate notice to seek other assistance.

Upon termination, fees are payable for work completed up to the date of termination. The firm will return client documents and materials upon full settlement of any outstanding fees.

11. Complaints

The firm takes all expressions of dissatisfaction seriously. If you have a concern about the service you have received, please write to us at [email protected]. We will acknowledge your concern within five working days and endeavour to resolve it fairly and without delay.

If a complaint cannot be resolved directly with the firm, clients may refer the matter to the Malaysian Bar's complaints procedures, details of which are available on the Bar Council's website.

12. Governing Law

These Terms and Conditions are governed by the laws of Malaysia. Any dispute arising from the use of this website or from a legal engagement with Bunga Damai shall be subject to the exclusive jurisdiction of the courts of Malaysia, with Kuala Lumpur as the primary venue.

13. Changes to These Terms

The firm may update these terms from time to time to reflect changes in our practices or in applicable law. Material changes will be noted at the top of this page with a revised date. Continued use of this website following any update constitutes acceptance of the revised terms. For clients with active engagements, any material change to terms will be communicated directly by email.
